Terms of Service

Please read these terms carefully before using influence.et. By using our platform, you agree to be bound by these terms.

Last updated: January 15, 2025

1. Acceptance of Terms

By accessing or using the influence.et platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

influence.et reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or platform notification. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

These Terms apply to all users of the Platform, including brands ("Advertisers"), content creators ("Influencers"), and visitors.

2. Account Terms

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.

You agree to provide accurate, current, and complete information during registration and to update your profile as needed. Accounts with fraudulent or misleading information may be suspended or terminated.

Each user may only maintain one account. Creating multiple accounts to circumvent restrictions or manipulate the Platform is strictly prohibited.

3. Campaign Terms

Advertisers may create and publish campaigns on the Platform, specifying requirements, deliverables, budget, and timelines. Campaign details must be accurate and not misleading.

influence.et acts as a marketplace connecting Advertisers and Influencers. We do not guarantee campaign results, engagement rates, or specific outcomes. Campaign success depends on factors outside our control.

Advertisers are solely responsible for ensuring that their campaigns comply with applicable laws, regulations, and advertising standards in Ethiopia and any other applicable jurisdictions.

Campaigns involving illegal products or services, misleading health claims, prohibited substances, or content that violates Ethiopian law are strictly prohibited and will be removed.

4. Bidding Terms

Influencers may submit bids on published campaigns. A bid constitutes an offer to perform the campaign deliverables at the proposed rate and terms.

Submitting a bid does not guarantee acceptance. Advertisers have sole discretion in selecting which bids to accept. influence.et does not influence or interfere with the selection process.

By submitting a bid, Influencers commit to fulfilling the campaign requirements if their bid is accepted. Failure to deliver on accepted bids may result in account penalties, negative reviews, or account suspension.

Bids may be withdrawn before acceptance by the Advertiser. Once a bid is accepted and a contract is formed, withdrawal is subject to the Contract Terms below.

5. Contract Terms

When an Advertiser accepts an Influencer's bid, a contract is formed between the parties through the Platform. Both parties agree to the deliverables, timeline, and compensation specified in the accepted bid.

Deliverables must be submitted through the Platform by the agreed deadline. Advertisers must review and approve or request revisions within the timeframe specified in the contract.

Either party may request modifications to the contract terms, subject to mutual agreement. Unilateral changes to contract terms are not permitted.

Disputes arising from contracts should first be addressed through direct communication between the parties. If unresolved, either party may request mediation through influence.et's dispute resolution process.

6. Payment Terms

All payments are processed through the Platform. Advertisers fund campaigns upon contract formation. Funds are held in escrow until deliverables are approved.

Upon approval of deliverables, payment is released to the Influencer minus the applicable platform service fee. Current fee rates are displayed on the Platform and may be updated with prior notice.

influence.et supports payment methods available in Ethiopia, including bank transfers and mobile money services. Payment processing times vary by method and financial institution.

Refunds are handled on a case-by-case basis through our dispute resolution process. Advertisers are not entitled to automatic refunds once deliverables have been submitted and approved.

7. Content Ownership & Licensing

Influencers retain ownership of all original content they create as part of campaign deliverables, unless otherwise specified in the contract terms.

By submitting deliverables through the Platform, Influencers grant Advertisers a non-exclusive license to use the content for the purposes specified in the campaign brief. The scope and duration of this license are defined in each individual contract.

Users retain ownership of all content they post on the Platform (profiles, portfolios, reviews). By posting content, you grant influence.et a non-exclusive license to display and distribute that content on the Platform.

You may not post content that infringes on any third party's intellectual property rights, violates any person's privacy or publicity rights, or otherwise violates applicable law.

8. Prohibited Conduct

Users may not: engage in fraudulent activity or misrepresent their identity, capabilities, or metrics; circumvent the Platform to conduct transactions directly and avoid service fees; use bots, scrapers, or automated tools to access the Platform; harass, threaten, or discriminate against other users; post spam, malware, or deceptive content.

Influencers may not artificially inflate their follower counts, engagement rates, or other metrics. influence.et reserves the right to verify metrics and suspend accounts found to be using artificial inflation methods.

Violation of these terms may result in warnings, temporary suspension, permanent account termination, and/or legal action, at the sole discretion of influence.et.

9. Termination

You may close your account at any time by contacting our support team. Account closure does not relieve you of obligations under any active contracts.

influence.et may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct that we determine, in our sole discretion, to be harmful to the Platform or its users.

Upon termination, your right to access the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

10. Limitation of Liability

influence.et provides the Platform "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free service.

To the maximum extent permitted by law, influence.et shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities.

influence.et's total cumulative liability for all claims arising from or related to the Platform shall not exceed the amount of fees paid by you to influence.et in the twelve (12) months preceding the claim.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to conflict of law principles.

Any disputes arising from or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Addis Ababa, Ethiopia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
